В работе рассматриваются ключевые аспекты регулирования онлайн-труда, включая справедливое обращение, недискриминацию, безопасность труда, право на объединение, конфиденциальность и защиту данных, а также проблемы классификации работников цифровых платформ. Исследование подчеркивает трансграничный характер онлайн-труда и связанные с этим юрисдикционные вызовы. Методология исследования основана на комплексном анализе норм международного права, научных трудов и правоприменительной практики. Полученные в ходе исследования выводы свидетельствуют о необходимости адаптации действующих механизмов правового регулирования к конкретным требованиям цифровой экономики, а также формирования в Казахстане новых, инновационных подходов к правовому регулированию онлайн-трудовых отношений. Результаты исследования позволяют сформировать систему конкретных рекомендаций, направленных на дальнейшее совершенствование трудового законодательства Республики Казахстан с учетом международных принципов и передового опыта в сфере правового регулирования онлайн-трудовых отношений.</p></abstract><trans-abstract xml:lang="en"><p>This study analyzes the principles of international legal regulation of online labor and their distinguishing features from traditional forms of employment, with a particular focus on their applicability and relevance to Kazakhstan. The paper examines key aspects of online labor regulation, including fair treatment, non-discrimination, occupational safety, the right to association, confidentiality and data protection, as well as the challenges of classifying digital platform workers. The research highlights the transnational nature of online labor and the jurisdictional challenges that arise as a result. The research methodology is based on a comprehensive analysis of international legal norms, academic literature, and law enforcement practice. The findings of the study indicate the need to adapt existing legal regulatory mechanisms to the specific requirements of the digital economy, as well as to develop new and innovative approaches to the legal regulation of online labor relations in Kazakhstan.
