Роль цифровой криминалистики в уголовных расследованиях в Республике Казахстан

Аннотация
В исследовании рассматривается роль цифровой криминалистики в уголовных расследованиях Казахстана, с акцентом на то, как собираются, анализируются и используются цифровые доказательства, такие как записи с камер видеонаблюдения, данные мобильных устройств и контент социальных сетей. На основе анализа нормативных документов, примеров из практики и правовых рамок подчеркивается расширяющееся применение технологий наблюдения, искусственного интеллекта и больших данных как в предотвращении преступлений, так и в обеспечении государственного контроля. Хотя цифровая криминалистика повышает возможности борьбы с киберпреступностью и мошенничеством, ее использование для мониторинга политического инакомыслия вызывает обеспокоенность в отношении гражданских свобод. В исследовании также выявлены основные правовые, технические и институциональные проблемы, влияющие на достоверность и допустимость цифровых доказательств в суде, включая расплывчатость законодательства, непоследовательность процедур и недостаточный регуляторный контроль. Работа вносит как практический, так и теоретический вклад в обсуждение цифровой криминалистики в переходных правовых системах. В качестве рекомендаций предлагается совершенствование стандартов доказательств, проведение правовой реформы и укрепление институционального потенциала, а также повышение прозрачности и этического контроля в области цифровой криминалистики.
